Frequently Asked Questions

How is the alimony amount determined?

The alimony amount is determined by the court, taking into account the income of the parties, standard of living, children's needs, and general economic conditions. Generally, a rate of 25-40% of income is applied.

What is the difference between child support and spousal alimony?

Child support is paid for the care and education expenses of children and continues until the child reaches the age of majority. Spousal alimony is paid to the party who would fall into poverty after divorce and can be indefinite (limited by changes made in 2024).

Can the alimony amount be updated?

Yes, if there is a significant change in the income situation of the parties, a lawsuit for alimony increase or decrease can be filed. Additionally, the court decision may specify an annual increase rate (usually at CPI/PPI rate).
